1. Acceptance of Terms

Welcome to Ojas.me ("Platform", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Ojas.me mobile and web application, including all content, features, and services made available through the Platform.

By registering for, accessing, or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

2. Eligibility

You must be at least 18 years of age to create an account and use the Platform. By registering, you represent and warrant that you meet this requirement.

3. Account Registration and Security

• You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must notify us promptly at connect@ojas.me if you suspect unauthorised access to your account.

4. Platform Services

Ojas.me provides digital wellness and self-discovery content, including scriptures, playbooks, algorithms, workshops, and an AI-powered wellness assistant grounded in ancient Indian wisdom traditions.

4.1 Wellness and Informational Content

Content on the Platform, including but not limited to articles, algorithms, assessments, AI-generated responses, wellness practices, guidance derived from ancient Indian knowledge systems (including, where applicable, Ayurveda, Yoga, Vedanta, Bhagavad Gita, and other traditional sources), workshops, and educational materials, is provided for educational, informational and personal wellness purposes only. Such content is not intended to diagnose, treat, cure, prevent, or manage any disease, medical condition, or mental health condition, nor should it be relied upon as or construed as medical, psychiatric, psychological, therapeutic, nutritional, legal, or financial advice. Always consult a qualified professional for such needs.

References to Ayurveda and other traditional knowledge systems are intended solely to promote general wellbeing, self-awareness, and education, and should not be relied upon as a substitute for professional medical advice, diagnosis, treatment, or emergency care.

Ojas.me does not guarantee that the content, recommendations, algorithms, AI-generated responses, workshops, assessments, or other materials will produce any particular physical, mental, emotional, financial, professional, or spiritual outcome. Any decisions or actions taken based on the Platform are solely at the user's own discretion and risk.

4.2 AI Assistant

When using the AI assistant, you agree not to share sensitive medical, financial, or third-party personal information beyond what is necessary for wellness guidance. AI responses may be reviewed for quality assurance and safety monitoring, as described in our Privacy Policy.

AI-generated responses are produced automatically and may occasionally be inaccurate, incomplete, or unsuitable for a particular individual or situation. Users are responsible for independently evaluating any information before relying upon it.

4.3 Premium Features

Certain features may require a premium subscription or approved access. We reserve the right to modify premium feature availability, pricing, and access criteria with reasonable notice where required.

5. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of applicable Indian law
• Attempt to gain unauthorised access to the Platform, other accounts, or our systems
• Upload, transmit, or distribute harmful, abusive, defamatory, or infringing content
• Reverse engineer, scrape, or systematically extract content except as expressly permitted
• Interfere with the proper functioning or security of the Platform
• Use the Platform contrary to its intended educational and wellness purposes.

We may suspend or terminate your account if we reasonably believe you have violated these Terms.

6. Intellectual Property

All content on the Platform — including text, images, audio, playbooks, algorithms, branding, and software — is owned by or licensed to YouInYou Philtech Foundation and protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes in accordance with these Terms. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

7. Donations and Payments

Where donation or payment features are made available, additional terms and the privacy practices of the relevant payment gateway will apply. Financial records may be retained as required under applicable tax and regulatory law.

Refund Policy

Unless otherwise required by applicable law, donations made to Ojas.me are voluntary, unconditional, and non-refundable.

Fees paid for workshops, retreats, events, subscriptions, or other paid services are generally non-refundable, except where:

• the event or service is cancelled by Ojas.me;
• a refund is expressly permitted under the applicable event or service terms; or
• a refund is required under applicable law.

Where a refund is approved, it will ordinarily be processed through the original mode of payment within a reasonable period.

Transfer of registrations, rescheduling requests, or credits for future events may be permitted solely at the discretion of Ojas.me and subject to the applicable event terms.

8. Third-Party Links and Services

The Platform may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is at your own risk and subject to their terms. We do not endorse or warrant any third-party websites, products or services merely because they are accessible through the Platform.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. Please review it carefully.

10. Disclaimers

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

We make no representation or warranty that use of the Platform will result in any particular physical, emotional, mental, professional, financial, relational, or spiritual outcome. Individual experiences and results may vary.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Ojas.me and its directors, officers, employees, volunteers, affiliates, advisors and agents shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, punitive or other damages or losses whatsoever, including but not limited to loss of profits, revenue, business, goodwill, opportunity, data, reputation, or any physical, mental, emotional, financial, professional, or spiritual loss or injury arising out of or in connection with:

• your access to or use of the Platform;
• reliance on any content, assessments, algorithms, AI-generated responses, workshops, retreats, events, books, or other materials made available through the Platform;
• any decision or action taken or not taken based on the Platform;
• interruption, suspension, delay, or unavailability of the Platform;
• any third-party services or websites; or
• any unauthorised access to or alteration of your information despite our reasonable security measures.

The Platform and all content are provided solely for educational, informational, and self-development purposes. You acknowledge that participation in any activity, practice, workshop, retreat, or implementation of any guidance is entirely voluntary and at your own discretion and risk.

To the fullest extent permitted by applicable law, you agree that Ojas.me assumes no responsibility or liability for the consequences of your use of, or reliance upon, the Platform or its content.

Without prejudice to the foregoing, where liability cannot be excluded under applicable law, our aggregate liability for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount you paid us (if any) in the twelve months preceding the event giving rise to the claim, or INR 5,000, whichever is lower.

Nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable law.

12. Indemnity

You agree to indemnify and hold harmless Ojas.me from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use or misuse of the Platform, violation of these Terms, violation of applicable law, or infringement of any third-party rights.

13. Account Termination

You may delete your account at any time through in-app settings or by contacting connect@ojas.me. We may suspend or terminate your account for breach of these Terms, legal compliance, or operational reasons, with notice where practicable.

Upon termination, your right to access the Platform ceases. Provisions that by their nature should survive termination will remain in effect.

13A. Force Majeure

We shall not be liable for any delay, interruption or failure in performance resulting from causes beyond our reasonable control including but not limited to natural disasters, governmental actions, internet failures, cyber-attacks, epidemics, power failures or similar events.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through a prominent notice on the Platform, email to your registered address, or by updating the Effective Date above. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Platform and may request account deletion.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

In case of conflict between these Terms and applicable Indian law, the applicable law shall prevail to the extent of the conflict.

The parties shall endeavour to resolve disputes amicably through good faith discussions before initiating legal proceedings.
